The purpose of the rider is to add language that\u2019ll protect you and remove clauses that may disadvantage you .&nbsp;If you don\u2019t have a real estate broker, we\u2019ll draft the contract for you and submit it to the buyer\u2019s attorney for approval.<\/p>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">Before signing the contract, be sure to come up with a&nbsp;<span style=\"font-weight: bold;\">list of items<\/span>&nbsp;in your home&nbsp;that\u2019ll be&nbsp;<span style=\"font-weight: bold;\">included<\/span>&nbsp;and&nbsp;<span style=\"font-weight: bold;\">excluded<\/span>&nbsp;from the sale of the property (for example, window treatments, HVAC units, certain appliances, and fixtures). These included and excluded items will then be listed in the contract or rider. Having the included and excluded items clearly laid out prevents the buyer from claiming any \u201cmissing items\u201d during the final walk-thru inspection.<\/p>\n<h4 style=\"color: #333333; line-height: 1.2; margin-right: 0px; margin-bottom: 16px; margin-left: 0px; font-size: 20px; font-family: 'PT Sans', sans-serif;\">The Mortgage Contingency<\/h4>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">The contract will contain a&nbsp;<span style=\"font-weight: bold;\">mortgage contingency clause,<\/span>&nbsp;which will state that&nbsp;<span style=\"font-weight: bold;\">the buyer may cancel the contract if<\/span>:<\/p>\n<ul style=\"margin-bottom: 26px; margin-left: 40px; color: #444444; font-family: 'PT Sans', sans-serif;\">\n<li style=\"list-style-type: disc;\">The buyer is denied a mortgage commitment<\/li>\n<li style=\"list-style-type: disc;\">The buyer is issued a mortgage commitment but the lender later withdraws it or<\/li>\n<li style=\"list-style-type: disc;\">The appraisal shows that the property\u2019s fair market value is less than the contract price.<\/li>\n<\/ul>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">However, if the buyer is unable to obtain a commitment within the&nbsp;time frame&nbsp;set forth in the contract and neither party agrees to an extension, then the&nbsp;<span style=\"font-weight: bold;\"><em>seller<\/em>&nbsp;now&nbsp;has the option to cancel the contract<\/span>.<\/p>\n<h4 style=\"color: #333333; line-height: 1.2; margin-right: 0px; margin-bottom: 16px; margin-left: 0px; font-size: 20px; font-family: 'PT Sans', sans-serif;\">The Deposit<\/h4>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">The buyer will pay the seller\u2019s attorney the&nbsp;<span style=\"font-weight: bold;\">deposit<\/span>&nbsp;(or down payment) and the funds will be kept in our firm\u2019s&nbsp;<span style=\"font-weight: bold;\">attorney escrow account<\/span>. The funds won\u2019t be released to the seller until the date of closing, unless the contract provides for it. If the buyer has a legal right to cancel the contract, the deposit will be refunded.<\/p>\n<h4 style=\"color: #333333; line-height: 1.2; margin-right: 0px; margin-bottom: 16px; margin-left: 0px; font-size: 20px; font-family: 'PT Sans', sans-serif;\">Documents to Gather<\/h4>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">Following attorney review, you\u2019ll be asked to provide a copy of the&nbsp;<span style=\"font-weight: bold;\">deed<\/span>,&nbsp;<span style=\"font-weight: bold;\">survey<\/span>&nbsp;(or survey certificate in the case of a condo), and&nbsp;<span style=\"font-weight: bold;\">title insurance policy<\/span>&nbsp;to the buyer. You may also be asked to provide the&nbsp;<span style=\"font-weight: bold;\">warranty cards<\/span>&nbsp;and&nbsp;<span style=\"font-weight: bold;\">owners manuals<\/span>&nbsp;of the appliances if they\u2019re available.<\/p>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">If you\u2019re&nbsp;<span style=\"font-weight: bold;\">married<\/span>&nbsp;but the house is only deeded in one spouse\u2019s name, the spouse who\u2019s name is not on the deed may be required to execute the deed to relinquish any rights to the property. This only applies if the house being sold is the seller\u2019s&nbsp;<span style=\"font-weight: bold;\">\u201cmarital home.\u201d<\/span>&nbsp;It doesn\u2019t apply to investment properties.<\/p>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">If you\u2019re selling a&nbsp;<span style=\"font-weight: bold;\">condominium<\/span>&nbsp;or&nbsp;<span style=\"font-weight: bold;\">townhouse<\/span>&nbsp;that has a&nbsp;<span style=\"font-weight: bold;\">homeowners association<\/span>, the buyer is entitled to obtain a copy of the<\/p>\n<ul style=\"margin-bottom: 26px; margin-left: 40px; color: #444444; font-family: 'PT Sans', sans-serif;\">\n<li style=\"list-style-type: disc;\">Master deed<\/li>\n<li style=\"list-style-type: disc;\">Bylaws<\/li>\n<li style=\"list-style-type: disc;\">Financial statements<\/li>\n<li style=\"list-style-type: disc;\">Insurance information<\/li>\n<li style=\"list-style-type: disc;\">Closing statement<\/li>\n<\/ul>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">Since the buyer has the right to cancel the contract based on any negative information in these documents, it\u2019s a good idea to provide these to the buyer earlier rather than later. You don\u2019t want to waste time having the property tied up in contract for a long time only to have it be cancelled.<\/p>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">Depending on the type of property or the municipality, you may also be required to provide the buyer with a<\/p>\n<ul style=\"margin-bottom: 26px; margin-left: 40px; color: #444444; font-family: 'PT Sans', sans-serif;\">\n<li style=\"list-style-type: disc;\">Certificate of occupancy<\/li>\n<li style=\"list-style-type: disc;\">Smoke detector &amp; carbon monoxide certificate<\/li>\n<li style=\"list-style-type: disc;\">Proof of fire extinguisher<\/li>\n<\/ul>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">Contact your real estate broker, the municipality, and the local fire department at least 3-4 weeks before the closing to obtain these documents.&nbsp;About a week before the closing, you\u2019ll need to contact your lender to obtain a&nbsp;<span style=\"font-weight: bold;\">payoff letter<\/span>&nbsp;to provide to the buyer\u2019s attorney.<\/p>\n<h4 style=\"color: #333333; line-height: 1.2; margin-right: 0px; margin-bottom: 16px; margin-left: 0px; font-size: 20px; font-family: 'PT Sans', sans-serif;\">The Buyer\u2019s Home Inspection<\/h4>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">As the seller, you\u2019re selling your property&nbsp;<span style=\"font-weight: bold;\">\u201cas is.\u201d<\/span>&nbsp;You only need to make sure that the major systems and appliances in the home are in&nbsp;<span style=\"font-weight: bold;\">\u201cgood working order\u201d<\/span>&nbsp;\u2013 not new or mint condition. Furthermore, the seller doesn\u2019t have to guarantee that these systems will be working a year after the closing either.&nbsp;Nevertheless, as the seller, you have a legal obligation to disclose any&nbsp;<span style=\"font-weight: bold;\">hidden material defects<\/span>&nbsp;that you may be aware of.<\/p>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">The buyer will most likely hire a&nbsp;<span style=\"font-weight: bold;\">home inspector<\/span>&nbsp;to inspect the property for material defects. The home inspector will prepare a report and the buyer\u2019s attorney will list out any defects that the buyer wants&nbsp;<span style=\"font-weight: bold;\">repaired<\/span>. Alternatively, the buyer may request a&nbsp;<span style=\"font-weight: bold;\">credit<\/span>&nbsp;at closing for the remaining defects. If the seller refuses to repair or issue a credit, the buyer may have the right to cancel the contract.<\/p>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">Try not to take the items raised by the buyer too personally. When determining whether to address the defect or allow the buyer to cancel, ask yourself whether the money saved from not addressing the defect outweighs the importance of the deal going through. If the cost of repairing the defect is reasonable, that may be the best course of action to take.<\/p>\n<h4 style=\"color: #333333; line-height: 1.2; margin-right: 0px; margin-bottom: 16px; margin-left: 0px; font-size: 20px; font-family: 'PT Sans', sans-serif;\">The Closing<\/h4>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">As the seller, you\u2019re not required to physically attend the closing. We\u2019ll draft a&nbsp;<span style=\"font-weight: bold;\">power of attorney<\/span>&nbsp;free of charge so that we can attend the closing and execute the documents on your behalf. On the morning of the closing, the property must be&nbsp;<span style=\"font-weight: bold;\">\u201cbroom-swept clean\u201d<\/span>&nbsp;and the buyer will conduct the&nbsp;<span style=\"font-weight: bold;\">final walk-thru inspection<\/span>. We\u2019ll also deliver the sets of keys, along with any mailbox keys, key cards, or garage door openers (if applicable) to the buyer.<\/p>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">We do not recommend closing the sale of your old home on the same day as the purchase of your new home.&nbsp;In the event that your new home is unable to close in time, a&nbsp;<span style=\"font-weight: bold;\">use and occupancy agreement<\/span>&nbsp;may be drafted. This is an agreement between you and the buyer that allows you to stay in your old home for an extended period of time after the closing at a predetermined per diem rate. The per diem rate is usually calculated by prorating the buyer\u2019s monthly&nbsp;<span style=\"font-weight: bold;\">PITI payment<\/span>&nbsp;(principal, interest, taxes, and insurance).&nbsp;If you anticipate that a use and occupancy agreement will be necessary in your situation, it should be brought up early in the process during the attorney review period, if possible.<\/p>\n<h4 style=\"color: #333333; line-height: 1.2; margin-right: 0px; margin-bottom: 16px; margin-left: 0px; font-size: 20px; font-family: 'PT Sans', sans-serif;\">Closing Costs<\/h4>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">In New Jersey, you\u2019ll be required to pay a&nbsp;<span style=\"font-weight: bold;\">realty transfer tax<\/span>&nbsp;of approximately 1% of the sales price to the county in which the property is located. The&nbsp;<span style=\"font-weight: bold;\">attorney\u2019s fees<\/span>&nbsp;and&nbsp;<span style=\"font-weight: bold;\">real estate broker\u2019s commission<\/span>&nbsp;will be due at closing and paid from the proceeds. If you are not current on your property taxes and sewer charges, these will be adjusted as well. Please note, if you are moving out-of-state or are selling a property in New Jersey but are not a New Jersey resident, the state will withhold 2% of the sales price until the following year. Bear in mind, however, that this is&nbsp;<span style=\"text-decoration-line: underline;\">not<\/span>&nbsp;a tax as the money will be refunded to you in the following year.<\/p>\n<h4 style=\"color: #333333; line-height: 1.2; margin-right: 0px; margin-bottom: 16px; margin-left: 0px; font-size: 20px; font-family: 'PT Sans', sans-serif;\">A Note on Short Selling a Property<\/h4>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">A&nbsp;<span style=\"font-weight: bold;\">short sale<\/span>&nbsp;situation occurs when the&nbsp;<span style=\"font-weight: bold;\">outstanding obligations<\/span>&nbsp;on a property (what is owed on the mortgage loan) exceeds what the property can be&nbsp;<span style=\"font-weight: bold;\">sold or refinanced for<\/span>. If a homeowner is having trouble keeping up with the mortgage payments, a short sale can be an appropriate alternative to foreclosure or bankruptcy.<\/p>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">In a short sale, the homeowner can avoid or mitigate the consequences of foreclosure by negotiating with the bank to have the home sold at the&nbsp;<span style=\"font-weight: bold;\">discounted price<\/span>. The proceeds from the sale are then used to&nbsp;<span style=\"font-weight: bold;\">pay off<\/span>&nbsp;a portion of the homeowner\u2019s mortgage loan.<\/p>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">Obtaining a short sale approval can be a difficult process.&nbsp;<span style=\"font-weight: var( --e-global-typography-text-font-weight );\">There is no guarantee that the bank will approve the short sale. However, if your mortgage payments are in&nbsp;<\/span><span style=\"font-weight: bold;\">arrears<\/span><span style=\"font-weight: var( --e-global-typography-text-font-weight );\">, the chances of short sale approval are greater.&nbsp;<\/span><span style=\"font-weight: var( --e-global-typography-text-font-weight );\">Our office can assist in negotiating with the bank to sell the property on terms that are more favorable to you. We can also draft the agreements and releases, provide data, and show proof of hardship to the bank on your
