When buying commercial property,&nbsp;<span style=\"font-weight: bold;\">current and future income streams<\/span>&nbsp;must be factored into the sales price. This may be affected by economic factors, nearby competition, real estate development in the area, and development in the neighborhood. If a buyer is able to identify factors that\u2019ll prove to be detrimental to the value of the property, he or she should attempt to negotiate&nbsp;<span style=\"font-weight: bold;\">concessions<\/span>&nbsp;from the seller to offset any problems. These concessions may ultimately effect whether the commercial property earns or loses money for your business.<\/p>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">Another important factor to consider is the&nbsp;<span style=\"font-weight: bold;\">transfer of liability<\/span>&nbsp;from the seller to the buyer. For example, if an&nbsp;<span style=\"font-weight: bold;\">environmental hazard<\/span>&nbsp;is found on the property, the buyer may be held responsible for the cleanup and any associated consequences, even if the seller caused the problem. Addressing&nbsp;liabilities&nbsp;such as this is a costly and time-consuming process. That\u2019s why it\u2019s imperative that various professional inspections be conducted to uncover these issues before closing on a commercial property.<\/p>\n<h4 style=\"color: #333333; line-height: 1.2; margin-right: 0px; margin-bottom: 16px; margin-left: 0px; font-size: 20px; font-family: 'PT Sans', sans-serif;\">Commercial Leasing<\/h4>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">More often than not, the use of a<span style=\"font-weight: bold;\">&nbsp;\u201cstandard lease form\u201d<\/span>&nbsp;is not the best option in a commercial leasing situation. Many landlords will use these standardized forms without fully understanding their meaning and tailoring them to their specific circumstances. Likewise, tenants will make little to no changes to the standard form, assuming nothing will go wrong during the lease term.<\/p>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">Unlike with residential leases, which are usually for a term of one or two years, a commercial lease can last for&nbsp;<span style=\"font-weight: bold;\">up to several years<\/span>. Furthermore, if the property is sold, the landlord may not be the same person or entity later down the road. These factors can lead to issues between landlord and tenant and the \u201cstandard lease form\u201d may not be enough to protect the interests of the parties involved. A&nbsp;myriad of other concerns may remain overlooked,&nbsp;under-negotiated, or&nbsp;misunderstood&nbsp;by both the landlord and tenant including, but not limited to:<\/p>\n<ul style=\"margin-bottom: 26px; margin-left: 40px; color: #444444; font-family: 'PT Sans', sans-serif;\">\n<li style=\"list-style-type: disc;\">How will the premises be used by the tenant?<\/li>\n<li style=\"list-style-type: disc;\">What signage is the tenant allowed to put up?<\/li>\n<li style=\"list-style-type: disc;\">Is the tenant allowed to sublet the property? If so, under what conditions?<\/li>\n<li style=\"list-style-type: disc;\">What is the landlord and tenant\u2019s responsibilities with respect to the security deposit?<\/li>\n<li style=\"list-style-type: disc;\">Are the cost of utilities to be shared by multiple tenants? Are they to be paid for by the landlord?<\/li>\n<li style=\"list-style-type: disc;\">Who is responsible for paying property taxes?<\/li>\n<li style=\"list-style-type: disc;\">Who is responsible for the maintenance&nbsp;and common charges for areas such as the parking lot and landscaping?<\/li>\n<li style=\"list-style-type: disc;\">Is the landlord willing to make improvements to the property on behalf of the tenant?<\/li>\n<\/ul>\n<p style=\"margin-bottom: 26px; padding: 0px; color: #444444; font-family: 'PT Sans', sans-serif;\">It\u2019s essential that both landlord and tenant incorporate language into the commercial lease agreement that\u2019ll safeguard each party\u2019s interests in the event of a&nbsp;<span style=\"font-weight: bold;\">breach of contract<\/span>&nbsp;by either side or any&nbsp;<span style=\"font-weight: bold;\">unforeseen circumstance<\/span>&nbsp;such as fire or natural
